Terms and Conditions


These terms and conditions are an important part of your driving tuition. Please read them carefully.


By taking driving lessons with Clear Pass School of Motoring it is accepted that you have read and agree to these terms and conditions. Clear Pass School of Motoring is an independent driving school owned by Stuart Giles MC. If there is need to raise a complaint, please speak to your instructor in the first instance. Should the issue not be resolved at this level, contact can be made via our administration email: admin@clearpass.co.uk


Driving Licence and Fitness to Drive
You must hold a current, valid driving licence (provisional or full) which must be produced on your first driving lesson and at regular intervals. Any changes to this licence, due to medical conditions or driving convictions, must be communicated to your instructor immediately. You must be able to read a number plate at a distance of 20.5m with glasses, if normally worn. It is important to wear any appropriate glasses or contact lenses during each and every lesson. For your comfort and safety, you are advised to wear suitable clothing. This should no restrict movement or cause embarrassment. All personal possessions are brought to a lesson at your own risk. Please advise of any medication you are taking which may affect your ability to drive safely. Similarly, it is important to advise the instructor of anything which you feel may impact on your ability to carry out the lesson safely. Clear Pass reserve the right to terminate or cancel a lesson if you are unable to meet the above conditions or are unfit to drive due to alcohol or drug misuse. The full training fee for the period in question will be lost or charged.


Condition of Lessons
All lessons will be taught on a one to one basis. They will be based on your individual needs and delivered in a calm, patient and courteous manner. Instructors will behave professionally and vehicles will be well maintained, clean and tidy. All vehicles have dual controls and full insurance for tuition purposes. You will be supervised closely at all times. However, Clear Pass cannot be held responsibl for any infringements of the law and any fines incurred will be the responsibility of the driver. Abusive or threatening behaviour will not be tolerated during a lesson. Clear Pass reserve the right to cancel a lesson at the student’s expense and withdraw tuition as a result.


Lesson Postponement
Instructors cannot be held responsible for late notice cancellations due to mechanical vehicle faults, accidents or sickness. If lessons are cancelle with less than 24 hours’ notice, every effort will be made to reschedule the lesson at a convenient time. Students will be charged in full if cancelling with less than 24 hrs notice. Contact your instructor in the first instance. Failure to turn up for a lesson will result in full payment being required for the missed lesson before any further lessons can be booked. Missed lessons will be deducted from a block booking total. Failure to attend or cancellation for three consecutive weeks will result in removal from their instructors list and there will be no guarantee of further lessons. You are advised to be punctual for lessons. Instructors will wait for a maximum of 15 minutes before a lesson would be abandoned or become due for payment. Time lost by student lateness cannot be added to a lesson. A reciprocal waiting time may be necessary if instructors are delayed for unforeseen circumstances. Instructors will endeavour to contact you in this instance and any lost time will be made up at the end of the lesson.

Payment
Lessons can be paid by cash or by bank transfer with the agreement of your instructor and should be made at the beginning of a lesson. Fees will be explained clearly at the time of booking. Block bookings must be paid for in full on the first lesson. Refunds will only be made in exceptional circumstances and at the discretion of the instructors. Clear Pass reserve the right to change prices at any time with reasonable notice.

The Driving Test
Clear Pass will make every effort to help you to reach a good standard of driving which will enable you to pass your test. Theory and practical tests are booked via www.gov.uk website. Practical tests are taken in Colchester once the Theory test has been passed. It is important that you continue your lessons on booking a test to ensure you are fully prepared. You must notify the school of test appointments promptly so that a car can be made available. In the interest of student and public safety, Clear Pass reserve the right to withhold use of the training car if your driving is deemed unsafe and not up to test standard. Clear Pass cannot be held responsible for any cancellation or postponement of tests by yourself or the DVSA.

Data Protection
All personal data held by the driving school (name, address, contact numbers, driving licence details) is stored securely and deleted once lessons are no longer being taken. From time to time, the school may publish photographs of students on social media for advertising purposes. Please notify your instructor if you wish to opt out of this section of the terms and conditions.
